Terms of Service
⚠️ Draft notice. This is a starter Terms of Service. Have a qualified lawyer review and tailor it for your jurisdiction (incorporation, governing law, dispute resolution, consumer-protection adjustments). Do not rely on this verbatim.
1. Agreement
By using BizQard (the "Service") you agree to these Terms. If you don't agree, don't use the Service. If you're using the Service for an organization, you confirm you have authority to bind that organization.
2. Your account
You're responsible for the activity on your account, including keeping your sign-in credentials safe. Notify us at [email protected] if you suspect unauthorized access.
You must be at least 13 years old (16 in the EU) to use the Service.
3. Your content
You own the content you put on your business card. By putting it in the Service, you give us a non-exclusive, worldwide license to host, store, display, and transmit it as needed to provide the Service (including showing your card to anyone with its URL or QR code, generating Wallet passes, and delivering it to people who scan it).
You're responsible for making sure your card content doesn't violate anyone else's rights (copyright, trademark, privacy, etc.). Don't put anything on your card you wouldn't be comfortable being public — your card profile is publicly viewable by URL.
4. Acceptable use
You agree not to:
- Use the Service to send spam or unsolicited messages.
- Impersonate someone else.
- Scrape, crawl, or harvest data from the Service in bulk without our written permission.
- Reverse-engineer, decompile, or otherwise attempt to extract source code.
- Use the Service to commit fraud, harass others, or break the law.
- Probe, scan, or test the vulnerability of the Service without our written consent.
- Interfere with the Service's normal operation (DoS, rate-limit evasion, etc.).
5. Service availability
We try to keep the Service available. We don't guarantee uptime, and we may change, suspend, or discontinue features with reasonable notice. Beta features are provided "as is" and may break.
6. Paid plans
Paid plans (when launched) are billed in advance for the period you choose. Charges are non-refundable except where required by law. You can cancel any time, and you'll continue to have access through the end of your paid period.
7. Termination
You can delete your account at any time from the app or by emailing [email protected]. We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BIZQARD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
10. Governing law
These Terms are governed by the laws of [JURISDICTION TO BE FILLED IN BY YOUR LAWYER]. Any dispute will be resolved in the courts of that jurisdiction.
11. Changes
We may update these Terms. If we make material changes, we'll email you at least 30 days before the new version takes effect. Your continued use after that constitutes acceptance.
